This restriction had for years created a legal loophole that, according to the source, could have enabled some individuals with prior convictions to obtain citizenship.

The solution announced by the minister at the time was to grant ministry employees access to the “private file” (Særakt) at the National Police (Rigspolitiet), where criminal records are kept for up to 30 years. However, according to official answers given by the minister to parliament last May, this solution has not yet been implemented.

A fierce attack from the opposition: “This is unacceptable” and “The government is dragging its feet in protecting Danish citizenship.”

This delay has led to a wave of sharp criticism from several opposition parties. In a series of statements to TV2, Mikkel Bjørn, the Danish People's Party's (Dansk Folkeparti) spokesperson on citizenship issues, said: "It's a hopeless situation. The minister announced a breakthrough more than a year ago, and no real progress has been made."“

Bjorn continued that this failure could in fact allow people who have committed serious crimes such as violence and assault to obtain citizenship if their conviction dates back more than ten years, making them invisible in the current criminal system.

Mette Abildgaard, spokesperson for the Conservative Party (Det Konservative Folkeparti), confirmed that the situation was “very serious” and that “it is unacceptable for the government to continue granting citizenship without conducting real background checks on applicants.”.

Steffen Larsen, spokesman for the Liberal Alliance, said: “It is astonishing that the problem still exists. Time is passing and we risk granting citizenship to people who may have a criminal record.”

Dramatic withdrawal from citizenship agreement

This crisis also triggered widespread political divisions, leading to the Conservative Party's withdrawal from the citizenship-by-investment pact in the summer of 2024. The party refused to vote in favor of granting citizenship to approximately 2,000 people due to a "lack of adequate oversight," as Mette Abellgaard confirmed, adding: "We were excluded from the pact simply because we raised logical questions about the effectiveness of the oversight."“

Despite the minister's assertion that participation in the citizenship agreement requires full commitment to all resulting decisions and legislation, Abellgord stressed that the government has not actually implemented what was agreed upon.

The minister said: “We are looking for a legally viable solution.”

In response to these criticisms, Minister Kor Depvad Bek said in a written statement to TV2: “The issue of insufficient information in the criminal record has been a concern for many previous ministers.
