Starting today, November 17, 2023, the new rules will come into force, which means that as a foreigner (third country citizen) you can in some cases work for short periods in Denmark, even if you do not have a residence and work permit, under the following conditions.<\/p>\n\n\n\n
You must be an employee of a company incorporated abroad and affiliated with a company incorporated in Denmark. The company in Denmark must have at least 50 employees.<\/p>\n\n\n\n
According to the new rules, it is possible to work for the company in Denmark for two separate periods within a 180-day period. Each period must not exceed 15 working days, and between periods, you must be outside Denmark for at least 14 days.<\/p>\n\n\n\n
Another requirement is that you can legally enter and reside in Denmark, either because you are a citizen of a visa-free country or because you have been issued a visa to use the new exemption rule.<\/p>\n\n\n\n
In some industries, the new rule can only be applied to administrative work or work requiring higher or intermediate-level knowledge. These industries include: construction, agriculture, forestry and horticulture, cleaning (including window cleaning), hotels and restaurants, and road freight transport.<\/p>\n\n\n\n
Foreign Minister Lars L\u00f8kke Rasmussen stated the following:<\/p>\n\n\n\n
\u201cI am very pleased that it will now be more flexible for Danish companies to bring their foreign employees to Denmark. Helping Danish companies create growth and jobs is a top priority for the government, and we have heard the criticism that the cumbersome procedures for obtaining residence and work permits for foreign employees have been a stumbling block for too long. In the USA and other parts of the world, the red carpet is rolled out for companies that want to make investments, and there are far too many examples for us in Europe where we trap companies in heavy bureaucracy and red tape. Now there will be less of a hurdle, and that is important for Denmark and for Danish businesses.\u201d.<\/p>\n\n\n\n
Minister for Immigration and Integration Karel Deppvad Beek also stated the following:<\/p>\n\n\n\n
\u201cI am pleased that Danish companies have been given the opportunity to easily and flexibly allow their international staff, who work abroad, to come to work in the group for short periods. Simply put, Danish companies cannot face challenges in transferring employees from their foreign departments to Denmark, even when they simply have to participate in work, for example, general group meetings. I believe we have provided a balanced solution, where we meet the needs of the business world for flexible rules at the same time as the rule is defined in a way that makes it unsuitable for abuse.\u201d<\/p>\n\n\n\n
