Previously, they had to meet several requirements in order to reunite the family in Denmark, for example, there were conditions relating to the length of education and a bank guarantee of more than 100,000 Danish kroner.<\/p>\n\n\n\n<p>But with the new requirements, families like them only have to meet the requirement of having a child together under the age of 18, depending on both parents.<\/p>\n\n\n\n<p>Prior to the change in practice, families with children were subject to rules governing marital reunification. There were four basic requirements:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>There must be at least one living space per resident and at least 20 square meters per person.<\/li>\n\n\n\n<li>One of the parents must have a valid residence status in Denmark through citizenship in Denmark or one of the other Nordic countries, or temporary or permanent residence.<\/li>\n\n\n\n<li>The 24-year rule means that both parties in a relationship must be 24 years old before they can achieve family reunification.<\/li>\n\n\n\n<li>The resident parent must provide a bank guarantee of 100,000 Danish kroner to cover any general expenses, such as cash benefits for the third-country parent. The funds are typically frozen for 10 years, but partial releases are possible once the third-country parent passes mandatory Danish examinations.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>But with the new change in practice, all these requirements have been waived for families consisting of a parent with Danish nationality, a parent from a third country and a joint minor child with Danish nationality.<\/strong><\/p>\n\n\n\n<p>Source: Ministry of Immigration and Integration<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-vivid-red-color has-text-color\"><strong>Children&#039;s rights are paramount<\/strong><\/p>\n\n\n\n<p>The requirements are relaxed based on an EU ruling from May of last year stipulating that a child has the right to live with both parents. The child&#039;s rights as an EU citizen are considered crucial. As Jens Vedsted-Hansen, a law professor at Aarhus University, explained: \u201cThe child\u2019s EU citizenship means that the parent from a third country (outside the EU) must be allowed to remain here, so that both parents can still care for the child together.\u201d.<\/p>\n\n\n\n<p>In other words, this means that a parent from a country outside the EU has the right to a residence permit in Denmark, otherwise the child will be forced to leave the EU. This would be a clear violation of the child&#039;s rights.<\/p>\n\n\n\n<p>Jens Vedsted-Hansen added that the European Court of Justice said this in a way that seems quite straightforward and is consistent with normal human experience: if both parents live with the child and both parents contribute to the support and care of the child, there is a presumption that the child is dependent on both of them.<\/p>\n\n\n\n<p>When it comes to Danish policy towards Danes who wish to bring their spouses to Denmark, where they do not have a child together, whether the requirements should be relaxed will be considered, according to Immigration and Integration Minister Kaar Dybvad.<\/p>\n\n\n\n<p class=\"has-vivid-red-color has-text-color\"><strong>Danish Minister for Immigration and Integration: \u201cThis applies to a very small minority of people.\u201d<\/strong><\/p>\n\n\n\n<p>But Immigration and Integration Minister Kar Dippvad says that the change will not make much of an impact: \u201cYou have to follow such provisions. That\u2019s what it means to be part of the EU. But even with this specific provision, our assessment is that it does not make a big difference to the number of people who get family reunification.\u201d.<\/p>\n\n\n\n<p>This is despite the fact that there was an increase in the number of applications from October 2022 to February 2023 compared to the same period in 2021 and 2022.<\/p>\n\n\n\n<p>The immigration minister adds: \u201cAlthough there has been an increase in the number of applications, this does not mean that they will all be approved.
